Terms of Service

Article 1 — Subject

These Terms of Service (hereinafter "ToS") govern the access and use of the foodcraft.app website and all its associated services (hereinafter the "Service"), published by Spark Aether Ltd, a company registered in England & Wales (UK Companies House).

By creating an account or using the Service, you accept these ToS without reservation. If you do not agree to these terms, you must not use the Service.

Article 2 — Definitions

"Service": the FoodCraft platform accessible via foodcraft.app, including all features for recipes, AI adaptation, meal planning, and nutritional tracking.
"User": any physical person creating an account and using the Service.
"Content": all recipes, texts, images, nutritional data, and AI-generated content available on the Service.
"Premium Subscription": the paid offer providing access to the advanced features of the Service.
"AI": the artificial intelligence systems integrated into the Service for recipe personalization and nutritional recommendations.

Article 3 — Access Conditions and Registration

Using the Service requires the creation of an account. Registration is free and open to any physical person at least 16 years of age.

By registering, you declare that you:

  • Are at least 16 years of age
  • Provide accurate and complete information
  • Have read and accepted these ToS as well as our Privacy Policy

FoodCraft reserves the right to refuse registration or suspend an account without notice in case of non-compliance with these ToS.

Article 4 — User Account

You are responsible for the confidentiality of your login credentials (email address and password). Any activity carried out from your account is deemed to be performed by you.

In case of suspected unauthorized use of your account, you must inform us immediately at hello@foodcraft.app.

You agree not to create multiple accounts for the same person, nor to use a third party's account without their permission.

Article 5 — Service Description

FoodCraft offers a personalized recipe and nutrition platform, organized around two plans:

5.1. Free Plan

The free plan includes:

  • Access to the entire recipe catalog (over 3,200 recipes)
  • Detailed nutritional information per recipe
  • Nutritional profile tracking (goals, allergies, diet)
  • Saving recipes to favorites
  • Step-by-step cooking mode with integrated timers

5.2. Premium Plan

In addition to the free plan, the Premium Subscription includes:

  • Unlimited AI adaptation of recipes based on your nutritional profile and dietary constraints
  • AI image analysis (ingredient identification, recipe suggestions)
  • Automatic generation of weekly meal plans
  • Smart shopping list, generated from your plans
  • Conversational AI coach for personalized nutritional recommendations
  • Family profile management with multi-profile adaptation

FoodCraft reserves the right to evolve the features included in each plan. Any substantial changes will be communicated to the users concerned.

Article 6 — Subscription and Payment

The Premium Subscription is offered as a monthly or annual subscription. Current rates are displayed on the Service's pricing page and may vary by country of residence.

Payment is processed entirely by Stripe, Inc., our PCI-DSS certified payment provider. FoodCraft does not collect or store any banking data.

The Premium Subscription includes a 3-day free trial period. At the end of this period, the subscription is automatically renewed and billed according to the chosen frequency (monthly or annual), unless canceled beforehand.

You can cancel your subscription at any time from your billing management area. Cancellation takes effect at the end of the current period. No pro-rata refunds are made for a period already started.

In case of payment failure, we will inform you by email. If payment fails repeatedly, access to Premium features may be suspended.

Article 7 — AI-Generated Content and Disclaimer

The Service integrates artificial intelligence technologies to personalize recipes, analyze ingredient images, generate meal plans, and provide nutritional recommendations.

AI suggestions and recommendations are provided for informational purposes only. They do not in any way constitute:

  • Medical advice or a diagnosis
  • A dietary prescription or a therapeutic meal plan
  • A substitute for consulting a qualified healthcare professional (doctor, dietitian, nutritionist)

The nutritional information displayed (calories, macronutrients, micronutrients) is calculated for indicative purposes and may vary depending on the actual ingredients used, portions, and preparation methods.

If you suffer from food allergies, intolerances, or any medical condition, you are required to personally verify the composition of recipes and consult a healthcare professional before changing your diet.

FoodCraft declines all responsibility for any damage resulting from the use of AI recommendations or nutritional information provided by the Service.

Article 8 — Intellectual Property

All content on the Service — including recipes, texts, images, logos, graphic elements, software, databases, and algorithms — is the exclusive property of Spark Aether Ltd or its licensors, and is protected by applicable intellectual property laws.

The User is granted a personal and non-exclusive right to use the Content as part of their normal use of the Service. Any reproduction, representation, modification, distribution, or commercial exploitation of the Content, in whole or in part, without the prior written authorization of Spark Aether Ltd, is strictly prohibited.

Recipes adapted by AI remain the property of FoodCraft. The User has a personal right to use the generated adaptations for their own use.

Article 9 — Prohibited Behavior

The User agrees not to:

  • Use the Service for illegal purposes or contrary to these ToS
  • Attempt to gain unauthorized access to FoodCraft's systems, servers, or databases
  • Engage in scraping, automated data extraction, or crawling of the Service
  • Perform reverse engineering, decompilation, or disassembly of the Service or its algorithms
  • Abuse AI features (mass automated requests, bypassing usage limits)
  • Resell, redistribute, or commercially exploit the Service or its content without authorization
  • Disrupt or compromise the functioning of the Service (DDoS attacks, malicious code injection, etc.)
  • Create fake accounts or impersonate a third party

Any failure to meet these obligations may result in the immediate suspension or deletion of the account, without notice or compensation.

Article 10 — Limitation of Liability

The Service is provided "as is". FoodCraft strives to ensure the availability and proper functioning of the Service but does not guarantee uninterrupted access or the total absence of errors.

FoodCraft cannot be held responsible for:

  • Temporary interruptions of the Service for maintenance or updates
  • Errors or inaccuracies in the content, including nutritional information and AI suggestions
  • Any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service
  • Consequences related to following the nutritional or dietary recommendations of the Service

To the fullest extent permitted by applicable law, FoodCraft's total liability to the User, for all causes combined, is limited to the amount of sums actually paid by the User during the 12 months preceding the event giving rise to liability.

Nothing in these ToS excludes or limits FoodCraft's liability for: death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other case where the law prohibits the exclusion or limitation of liability.

Article 11 — Termination

The User can delete their account at any time via account settings or by contacting hello@foodcraft.app. Deleting the account results in the erasure of all associated personal data within 30 days, subject to legal retention obligations.

FoodCraft reserves the right to suspend or delete a User's account in case of:

  • Violation of these ToS
  • Abusive or fraudulent use of the Service
  • Repeated non-payment of the subscription
  • Prolonged account inactivity (24 months without login)

In case of termination by FoodCraft for serious cause, no refund will be made. In case of termination without fault of the User, a pro-rata refund may be considered.

Article 12 — Protection of Personal Data

The processing of your personal data is governed by our Privacy Policy, accessible at foodcraft.app/privacy.

By using the Service, you acknowledge having read our Privacy Policy and accept the processing of your data as described therein.

Article 13 — Governing Law and Jurisdiction

These ToS are governed by English law (laws of England and Wales).

Any dispute relating to the interpretation or execution of these ToS falls under the exclusive jurisdiction of the courts of England & Wales.

However, if you reside in the European Union, you benefit from mandatory consumer protection provisions of the law of your country of residence. Nothing in these ToS affects your right to bring proceedings in the competent courts of your place of residence.

In accordance with European Regulation No. 524/2013, you can use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Article 14 — Changes to These ToS

FoodCraft reserves the right to modify these ToS at any time. Changes will take effect upon their publication on the Service.

In the event of a substantial change, we will inform you by email or via a visible notification on the Service at least 30 days before the new conditions take effect.

Continued use of the Service after the changes take effect constitutes acceptance of the new ToS. If you do not accept the changes, you must stop using the Service and delete your account.

Article 15 — General Provisions

If any clause of these ToS is declared null or inapplicable by a competent jurisdiction, the other clauses remain in full force.

The failure of FoodCraft to exercise a right or prerogative provided for by these ToS does not constitute a waiver of that right.

These ToS, along with the Privacy Policy, constitute the entire agreement between the User and Spark Aether Ltd regarding the use of the Service.
